GENERAL TERMS AND CONDITIONS AND HOUSE RULES 2nd Floor Studio Vienna | Photo Studio, Jörgerstraße 50, 1170 Vienna (JRG GmbH represented by Daniel Irsigler)

These General Terms and Conditions and House Rules apply to all contracts, services, and infrastructure provided by JRG GmbH to its contractual partners, even if not expressly referenced. JRG GmbH reserves the right to amend these terms and house rules at any time with immediate effect on existing contracts. The current version can be accessed on the JRG GmbH website (2ndfloor.studio).

1. GENERAL
1.1. All contractual relationships are based on the current rental agreement, these terms and conditions, and any additional posted behavior and community rules.
1.2. At the time of contract, the user must disclose all company data (e.g., VAT number) and provide evidence as requested by JRG GmbH.
1.3. Users must provide a valid delivery address at contract signing and notify JRG GmbH immediately of any changes. Deliveries can be legally made to the address at Jörgerstraße 50, 1170 Vienna, if mail is undeliverable or no address is provided.
1.4. The user agrees that legal successors of JRG GmbH may assume all rights and obligations by merely notifying of the succession.
1.5. JRG GmbH is liable only for intentional or gross negligence in contractual obligations, with liability limited to three gross monthly fees.
1.6. Parties may terminate the agreement immediately for just cause, such as non-payment of fees or severe breaches of contract or terms.
1.7. Parties waive the right to contest the contract due to mistake or loss of business basis, acknowledging the fairness of the agreement.
1.8. Offsetting user claims against fees or other payment obligations to JRG GmbH is prohibited.
1.9. No oral side agreements exist, and changes to the contract require written form.
1.10. This contractual relationship is governed by Austrian law, with exclusive jurisdiction in Vienna.
1.11. If any provision is invalid, the validity of the remaining provisions remains unaffected.

2. HOUSE RULES
2.1. Spaces may only be used for their contractual purpose.
2.2. Users must avoid disturbing others, especially noise and odors.
2.3. Quiet hours are enforced from 9 PM to 7 AM, with special consideration on Sundays and public holidays.
2.4. The studio and common areas must be kept clean; users are responsible for any cleaning costs due to their actions.
2.5. Doors and windows must be securely locked at night or during bad weather.
2.6. Waste must be properly sorted and disposed of; hazardous materials are not to be disposed of in regular trash.
2.7. Studio and common areas must be kept clear of obstructions.
2.8. Bikes, scooters, and similar items may only be stored in designated areas.
2.9. Vehicles may not be parked on property grounds.
2.10. Heavy items must be moved carefully; the user is liable for any damage caused.
2.11. Courtyards are to be used only as contractually specified and with written permission.
2.12. Users are responsible for cleaning the studio and maintaining order.
2.13. Users must ensure cleanliness in sanitary facilities and are liable for any damages caused.
2.14. Technical facilities must only be operated by authorized personnel; unauthorized tampering by users is strictly forbidden.
2.15. Users must help prevent unauthorized use of the premises.
2.16. The premises must be kept free of pests.
2.17. Users must ensure adequate ventilation, heating, and lighting.
2.18. No animals are allowed.
2.19. Smoking is strictly prohibited.
2.20. The studio and provided equipment are available to authorized users as available.
2.21. Reservations must be made through the website (2ndfloor.studio).
2.22. No guarantee is provided for the availability of the studio.
2.23. Use of the studio and equipment is at the user's own risk.
2.24. The studio is available for use from 9 AM to 8 PM.
2.25. After use, the studio must be vacated and left clean; technical equipment must be returned in good working condition. Users must report any damages immediately.
2.26. Users must not engage in any unlawful or immoral activities within the studio.
2.27. Users are expected to handle the studio and equipment with utmost care.
2.28. Equipment must only be used after proper instruction; users are liable for any damage due to improper use.
2.29. The above terms apply generally.
